Shared Sweeps Terms of Service

Below are the terms and services for Shared Sweeps, LLC.

Please read these Terms of Service (“Terms”) carefully. By using the Service (defined below), you’re agreeing to these Terms, which will result in a legal agreement between you and Shared Sweeps LLC (collectively, “Shared Sweeps”, “we”, or “us).

Shared Sweeps is a shared sweepstakes platform that allows brands to incentivize certain actions on their website with entries to a sweepstakes like purchasing and signing up for their email/sms list.

Eligibility

In order to use the Service, you must:

  1. be at least eighteen (18) years old and able to enter into contracts
  2. sign and receive a signed copy of our contract from Shared Sweeps
  3. agree to these Terms and the other terms and conditions linked in these Terms that form part of the Agreement
  4. provide true, complete, and up-to-date contact and billing information.

Term

The term of the will be stated on your contact. Due to the nature of sweepstakes, contracts do not auto renew for our future sweepstakes. Both parties are able to cancel the agreement at any point. If you terminate your contract you agree to suspend any and all marketing of the Shared Sweeps sweepstakes and will be billed for any services used before the termination date.

Changes

We may change any of the Terms by posting revised Terms on the Shared Sweeps site. Unless you terminate your account, the new Terms will be effective immediately upon posting on the effective date indicated in the new Terms, as applicable, and apply to any continued or new use of the Service. Any changes to the Terms will be communicated via email.

Below are the appropriate disclaimers that should appear on all of the advertising pieces below.  If there are any advertising pieces not listed below, please let us know and we can review and provide the appropriate disclaimer.

All marketing also needs to state one of the following:

The point of this is to ensure all of your customers or potential customers know that this is a shared sweepstakes and that you are not the sole sponsor.

Twitter/Facebook/Instagram Note:  Despite the character limit, the legal disclaimers are still required on social networks; however, many elect to exclude disclaimers as a standard due to the character limit.  NSC always recommends disclosing the minimum required disclaimers when advertising the sweepstakes as required by law (see minimum disclaimers below).  Failure to use such disclaimers will be at the sole risk of the Sponsor.

  • Broadcast Advertising (Radio and Television)
    • Radio: All disclaimers must be clearly stated at some point within the radio script.  They must be stated in a reasonable amount of time for the consumer to clearly understand them.
    • TV: All disclaimers must be posted on the commercial.  Having them posted at the bottom of the screen for the entire duration of the commercial is the best way.  Otherwise, they can be placed on screen at the end of the commercial, giving a reasonable amount of time for the consumer to clearly read and understand them.

Hold Harmless

Customer shall indemnify, defend, and hold harmless Shared Sweeps and its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) that arise from or relate to any breach of this Agreement by Provider, or any errors or malfunctions. Shared Sweeps shall have no liability for any claims, demands, losses, damages, judgments, settlements, costs, and expenses that arise from or relate to the unauthorized use of the platform, or from any third-party claims against Client related to any usage.

Case Study

Customer agrees to collaborate with Shared Sweeps to produce a case study regarding the success of their usage of the Shared Sweeps marketing campaign to be used publicly. The case study is subject to the customer’s approval.

Logo Consent

Shared Sweeps may include the customer’s name, logos, or trademarks in a list of Shared Sweeps’ current or previous customers.

Payment Terms

All payment terms are net-15 unless otherwise stated. Late fees are subject to a 1.5% per month interest rate and/or termination of the contract.

Grand Prize

You are able to market the total grand prize of the sweepstakes however you think it will best resonate with your customers. IE A $100,000 grand prize can be $100,000 paid to the grand prize winner, a $50,000 car and $50,000 cash, a $25,000 vacation and $50,000 cash. In the case of you marketing a $50,000 car + $50,000 cash we will find the grand prize winner a car that meets the criteria and provide the rest in cash. The ARV of the grand prize will be $100,000 exactly. Shared Sweeps must approve how you market the grand prize.
